Watch the video Is CEO Glapiński’s second term a safe option for the markets?
On the growing nervousness surrounding the candidacy for the Presidential Palace Adam Glapiskiwrote RMF FM. And indeed there was a controversy there a few weeks ago, because knowledge of the legal doubts reached Duda after sending the president’s request to appoint Glapiński. President Andrzej Duda harbored a grudge against the entourage of him who immediately – before selecting “Glapa” as presidential candidate NBP – his collaborators have not claimed that there is a legal problem on this, which is confirmed by the appraisals obtained at the Palazzo by the new lawyers.
– Now it’s becoming more and more of a mess. Everyone makes the right face for a bad game, says a ruling camp politician familiar with the case.
The key moment is three and a half months in 2016. On 1 March 2016 Glapiński became a member of the board of the NBP (by decision of the president of 29 February). In June he was “promoted” to the presidency of the NBP president (the Sejm took a decision on the matter on June 10 and Glapiński was sworn in 21 June).
Glapiński’s reconfirmation may violate art. 17 section 2b of the Law on the National Bank of Poland: “the members of the board of directors of the NBP are appointed for a period of six years. The provisions of Article 9 paragraph 2, Article 13 paragraph 3 and paragraphs 5-7 apply accordingly “. The aforementioned art. 9 sec. 2 indicates that the term of office of the president of the NBP is six years and the same person cannot be president of the central bank for more than two consecutive terms.
The President’s motion to appoint Glapiński is still in effect. As a possible alternative to Glapiński in the field of government, you can mainly hear Marek Dietl, chairman of the Warsaw Stock Exchange. However, there is still no decision to change Glapiński. Most likely – we hear – the president will wait for what Seym will do, which will have to face Glapiński’s candidacy at the next meeting. PiS is mobilizing a lot for this meeting.
Andrzej Duda was strongly in favor of Glapiński’s candidacy. Similarly, Jarosław Kaczyński wanted his old friend as the chairman of the NBP president again. And Glapiński himself dreamed of another six years as president. At the Palazzo, he was greatly supported – today only the president’s social advisor – Paweł Mucha, who is currently Adam Glapiński’s full-time advisor at the National Bank of Poland.
In turn, in the field of government, the elimination of Glapiński would have been welcomed by Prime Minister Mateusz Morawiecki and also by Deputy Prime Minister Jacek Sasin.
– There could be a huge legal problem in the future with the election of Glapiński – says a well-informed politician from the ruling camp.
Donald Tusk said just now that “decisions made illegally by the PiS will not require – in my view – legal repeal, they are illegal and will simply be repealed”. If Glapiński’s election were burdened – according to the opposition – with a disadvantage, then in the words of the head of the Civic Platform, Glapiński’s election would simply be invalid. To avoid this, the PiS was able – and has repeatedly used this route – with the hands of the Constitutional Tribunal, to force an interpretation of the act in such a way as to consider Glapiński’s election to the board of directors of the central bank in full. legal for the third time.
Especially if the opposition has won the next elections, but also without. Because even in a situation where the Glapiński-led Monetary Policy Council will continue to raise interest rates, the court may decide in the future that these decisions are invalid, because the chairman of the NBP, who is also the head of the Council , was illegally elected. All of Glapiński’s decisions would be in jeopardy.
